MINUTES OF THE REGULAR MEETING OF THE PLANNING COMMISSION OF THE CITY OF NORTH MUSKEGON October 9, 2002The meeting was called to order at 6:07 p.m. COMMISSIONERS PRESENT William Boyd, Park Kersman, Tracy Sodini, Dennis Stepke, and Chris Witham.(5) COMMISSIONERS ABSENT Donna Spytma, Steven Szatkowski, Harry Wierenga, and Kenneth Winter.(4) 2002-23 APPROVAL OF MINUTES - SEPTEMBER 19,2002 Kersman moved, Sodini seconded, to approve the minutes of September 19, 2002 as presented. MOTION CARRIED. 2002-24 HOME OCCUPATION PERMIT REQUEST - LEMIEUX CONSTRUCTION, 1102 CENTRAL LeMieux Construction Company, 1102 Central, North Muskegon, MI 49445 is requesting a license to operate a home office. There will be no equipment, additional traffic, signage, or employees at the home. Mr. LeMieux was present and presented his plan to the Planning Commission. Kersman moved, Stepke seconded, to grant the home occupation permit to LeMieux Construction Company, 1102 Central, North Muskegon, MI 49445 as presented. MOTION CARRIED. 2002-25 HOME OCCUPATION PERMIT REQUEST - JENNIFER (BOGUE) YERKIE, 2021 MOULTON Ms. Yerkie is requesting to open a home daycare at 2021 Moulton. Ms. Yerkie was not present at the meeting to answer questions of the Commission. Stepke moved, Kersman seconded, to table this request until the applicant can be present to answer questions of the Commission. ALSO PRESENT Tod Mowrey, Planning Consultant. 2002-18 APPROVAL OF MINUTES - JUNE 12, 2002 AND AUGUST 14, 2002 Stepke moved, Witham seconded to approve the minutes of June 12, 2002 and August 14, 2002 as presented. MOTION CARRIED. 2002-19 ZONE CHANGE REQUEST AT 1813 RUDDIMAN Mr. David Kennedy of 746 Ruddiman Drive, North Muskegon, Michigan 49445 is requesting a zone change for the property located at 1813 Ruddiman Drive, North Muskegon from commercial to multiple family dwelling. He is planning to build an upscale duplex on the property. Wierenga moved, Witham seconded to deny the request of Dave Kennedy for a zone change at 1813 Ruddiman to rezone the property from commercial to multiple family because it does not comply with the master plan and it would cause future development to have limitations. Ayes: Commissioners Boyd, Kersman, Sodini, Spytma, Szatowski, Wierenga, Witham and Stepke. (8) Nays: Winter. (1) MOTION CARRIED. 2002-20 LOT SPLIT REQUEST FOR 723 FOWLER Mr. K.C. and Anna Fowler or 1186 N. Robinhood Dr., Muskegon, MI 49445 is requesting a lot split at 723 Fowler enabling him to build a new home closer to Bear Lake. Mr Fowler stated that he had spoken with the neighbors and had positive feed back. Discussion took place regarding environmental issues, traffic problems, actual address of the property and future variances. Wierenga moved, Stepke seconded to allow the lot split at 723 Fowler as described with a full site plan review at a later date. Ayes: Commissioners Boyd, Kersman, Sodini, Szatowski, Wierenga, Winter, Witham and Stepke. (8) Nays: Spytma. (1) MOTION CARRIED. 2002-21 PUBLIC HEARING -PROPOSED ZONING ORDINANCES Stepke moved, Witham seconded to open the public hearing for the proposed zoning ordinance. MOTION CARRIED. Discussion followed with Tod Mowrey, Planning Consultant commenting. Planning Commission commended Mr. Mowrey for his input and direction during this long task. Stepke moved, Wierenga seconded to close the public hearing. MOTION CARRIED. Witham moved, Boyd seconded to approve the new zoning ordinance as presented. (7) COMMISSIONERS ABSENT Donna Spytma and Tracy Sodini. (2) 2002-13 HOME OCCUPATION REQUEST AT 660 SOUTH BUYS Megan K. Perrault, 660 South Buys, North Muskegon, MI 49445, is requesting a license to operate a small printing service out of her home. The home office will consist of a computer and printer. It will not generate any additional noise, vibration, odors, or electrical interference at levels above that of a normal residence. There will be no employees, signage or additional traffic. The business will operate during daytime working hours only and if it becomes too successful, will be relocated to another location. Winter moved, Wierenga seconded, to grant a home occupation permit to Megan K. Perrault, at 660 South Buys, North Muskegon, MI 49445, to operate a small printing service as presented. MOTION CARRIED. 2002-14 HOME OCCUPATION REQUEST AT 708 MOULTON AVENUE Julie Reynolds, 708 Moulton, North Muskegon, MI 49445, is requesting a license to operate a freelance graphic design business in her home. The office will consist of a home computer. There will be no employees, signage or additional traffic. The business will operate on a part-time basis only. Wierenga moved, Stepke seconded, to grant a home occupation permit to Julie Reynolds, 708 Moulton Avenue, North Muskegon, MI 49445, to operate a freelance graphic design business as presented. MOTION CARRIED. 2002-15 HOME OCCUPATION REQUEST AT 757 MOULTON AVENUE James Camp, 757 Moulton Avenue, North Muskegon, MI 49445, is requesting a license to operate Camp Consulting Services, a home office that will consist of reviewing and dictation of confidential medical records for workman compensation cases and medical malpractice lawyers. The home office will consist of a home computer. There will be no employees, signage or additional traffic. Kersman moved, Szatkowski seconded, to grant a home occupation permit to James Camp at 757 Moulton Avenue, North Muskegon, MI 49445, to operate Camp Consulting Services, a business which reviews medical records as presented. MOTION CARRIED. 2002-16 HOME OCCUPATION REQUEST AT 107 CALIFORNIA Deb Cooper, 107 California, North Muskegon, MI 49445, is requesting a license to operate Hitsman Enterprises, licensed builder out of her home. The home will be used as a mailing address and there will be no equipment, storage of machinery, or retail sales at the home. There will be no employees, signage or additional traffic. Gerald Hasper, 322 Buys Road, questioned if storage of heavy equipment will be allowed on site or if noise will be generated by heavy equipment. Ms. Cooper stated that all of her equipment will be stored at another location and there will be no noise generated. Wierenga moved, Winter seconded, to grant the home occupation permit to Deb Cooper, at 107 California, North Muskegon, MI 49445, to operate Hitsman Enterprises, licensed builder from her home as presented. Ayes: Boyd, Kersman, Szatkowski, Wierenga, Witham, Winter. (6) Nays: Stepke. (1) MOTION CARRIED. 2002-17 REVIEW OF PROPOSED NEW ZONING ORDINANCES Commissioners were asked to share comments and concerns about the new zoning ordinances. The following areas were discussed: - The number of recreational vehicles that can be stored in a yard. - The height of a fence at front yard property lines, along sidewalks, and on corner lots. - The allowable pitch of a roof on mobile homes in a mobile home park. The commisison decided to set a date for a public hearing instead of convening the subcommittee to further address these issues. Dennis Stepke volunteered to check on the requirements of having separate or joint public hearings for planning commission and city council. MINUTES OF THE REGULAR MEETING OF THE PLANNING COMMISSION OF THE CITY OF NORTH MUSKEGON June 12, 2002 The meeting was called to order at 6:00 p.m. COMMISSIONERS PRESENT William Boyd, Donna Spytma, Dennis Stepke, Steven Szatkowski, and Chris Witham.(5) COMMISSIONERS ABSENT Park Kersman, Tracy Sodini, Harry Wierenga, and Kenneth Winter (arrived 6:45 p.m.).(4) 2002-10 APPROVAL OF MINUTES - MAY 8, 2002 Stepke moved, Witham seconded, to approve the minutes of May 8, 2002 as presented. MOTION CARRIED. 2002-11 HOME OCCUPATION PERMIT REQUEST - THOMAS BURMEISTER, 726 OAKMERE PLACE Thomas Burmeister, 726 Oakmere Place, North Muskegon, MI 49445-2815 is requesting a home occupation license to operate B-Sharp, a sharpening business. This home base business utilizes the garage and equipment consist of bench grinders, belt sanders, and other sharpening machines. There will be no employees and traffic will be limited to short periods of time while dropping off work to be completed. It is strictly a service business and there will be no sales. Mr. Burmeister presented his application to the Planning Commission. Several neighbors were present to ask questions of Mr. Burmeister. Mr. Burmeister stated that he would operate his business from 8:00 a.m. or 9:00 a.m. until 5:00 p.m. Monday through Friday. His machines are very quiet and operate on 1/3 to 1/2 horsepower. The garage will be secured, locked, and insulated. Lawnmower blades are approximately ten (10%) percent of the business. Letters were placed on file in the Clerk’s Office from the following residents: Martha Stribley, 724 Moulton, stating that she is in favor of issuing a permit Bernard Craigie, 731 Lake Drive, stating he is against issuing the permit Mr. and Mrs. Oslund, 735 Oakmere Drive, stating that they are in favor of issuing a permit Harriet Davis, 715 Lake Drive, stating that she is against issuing the permit The Planning Commission explained that home occupation permits are reviewed on an annual basis and can be revoked. Witham moved, Boyd seconded, to grant the home occupation permit to Tom Burmeister, owner of B-Sharp, at 726 Oakmere Place, North Muskegon, MI 49445, to operate a sharpening business from the hours of 8:00 a.m. to 5:00 p.m. Monday through Friday as presented. MOTION CARRIED. 2002-12 HOME OCCUPATION PERMIT REQUEST - RON ALLEN, 922 MOULTON Ron Allen, 922 Moulton, North Muskegon, MI 49445 is requesting a home occupation license to operate Kera Creations. This home base business utilizes a studio office within the home as a place of design for landscaping. There will be no employees. Mr. Allen presented his application to the Planning Commission and gave an explanation. He stated that there would be no signage or trucks. Commissioner Winter arrived at 6:45 p.m. Stepke moved, Szatkowski seconded, to grant the home occupation permit to Ron Allen, 922 Moulton to operate Kera Creations, a design landscaping business, as presented. MOTION CARRIED. 2002-8 SPECIAL USE PERMIT AT 321 -325 CENTER -TABLED AT APRIL 10, 2002 MEETING Witham moved, Stepke seconded, to remove the Special Use Permit for 321-325 Center from the table. MOTION CARRIED. Gary Farwig, 1613 Ruddiman Drive, North Muskegon, MI 49445, is requesting a Special Use Permit for 321-325 Center, North Muskegon, MI 49445 to operate retail on the lower level and apartments on the upper level of the building. This request was tabled at the April 10, 2002 until such time that Mr. Farwig could provide agreements to share parking with surrounding businesses to show adequate parking. Mr. Farwig presented a letter from John Nedeau of J. Nedeau Realtor, Inc., 1843 Ruddiman Drive, North Muskegon, MI 49445, stating that he will lease four parking spaces off the alley in the paved area of the building. He also stated that he will remove the dumpster and prepare a lease. Stepke moved, Winter seconded, to approve the Special Use Permit for 321-325 Center contingent upon signing an ongoing lease agreement for a minimum of four extra parking spaces. MOTION CARRIED. 2002-9 HOME OCCUPATION PERMIT REQUEST - EDWARD HILTON, 700 FRANKLIN STREET Edward Hilton, 700 Franklin Street, North Muskegon, MI 49445, is requesting a home occupation license to operate Barrier Free Manufacturers, assembling physically challenged wireless and wired control switches for the automated door industry. There will be no additional traffic except the occasional delivery truck. There will be no heavy manufacturing. A letter was received from Michael and Patti Ann Brallier, 610 Franklin, stating that they approve of the home occupation request from Mr. Hilton, but stated that they are concerned about the speed of the UPS trucks and asked that the City investigate the issue. A neighbor from Lyncott was present to ask additional questions and stated that he wanted to be sure that there would be no heavy manufacturing. Stepke moved, Winter seconded, to approve the home occupation for Edward Hilton, 700 Franklin Street as presented. MOTION CARRIED. MOTION CARRIED. 2002-6 SPECIAL USE PERMIT AT 321-325 CENTER Gary Farwig, 1613 Ruddiman Drive, North Muskegon, MI 49445, is requesting a Special Use Permit for 321-325 Center, North Muskegon, MI 49445 to operate retail on the lower level and apartments on the upper level of the building. Mr. Farwig gave an overview of the project stating that he will gut the walls and replace the windows on the second floor. Four additional parking spots will be added and an enclosed stairway will be added to the back of the building by removing the area that was Tans and Tapes (plans with exact locations are available in the Clerk’s office). The Planning Commission expressed concern with the number of parking spots available. Chairman Spytma stated that the required amount of parking spaces is 23. Stepke moved, Wierenga seconded, to table the Special Use Permit request until such time that Mr. Farwig can provide agreements to share parking with surrounding businesses to show adequate parking. The Planning Commission noted that no one outside of Mrs. Keene’s immediate family was allowed to assist her with the business inside her home. The Planning Commission questioned parking and traffic flow. Ms. Christiansen stated there would be little traffic and only one or two customers at a time.
